ADDITIONAL REGULATIONS FOR HEMP
The below terms are in addition to Elsoms Seeds Ltd. standard Terms of Sale effective from 1st October 2022 and are specific to the sale of Hemp seed.
Effective from 1st February 2024
THC CONTENT
the supplied seed meets Home Office approved tetrahydrocannabinol (THC) content and is intended for the production of hemp fibre for industrial purposes, or obtaining seeds which are used for their nutritional content or pressed for oil. For these uses, licences are granted to growers by the Home Office to enable the use of non-controlled parts of the plant (i.e., seeds and fibre/mature stalk only). This policy is only applicable where non-controlled parts of the plant are used and does not allow for use of ‘green’ material – i.e., the leaves and flowers as these are controlled parts of the plant. There needs to be a defined commercial end use and the Home Office will only issue licences for cultivation of plants from approved seed types with a THC content not exceeding 0.2%.
LICENCES
Growers can buy seed for these purposes, but it is at their liability to ensure that they have the correct licence in place from the Home Office before they grow a crop.
SUBSTITUTIONS
If Elsoms are unable to supply the variety ordered, there will be no automatic substitution of seed, but Elsoms reserves the right to offer alternative varieties at the point of the order being made, or before despatch. It is the licensee’s responsibility to inform the Home Office of any changes made to the variety and that they are still covered to grow the alternative variety by their licence.
